B. Referral/Attribution and Accounting — Monarch Labs Joint Venture Program

If you were referred to us through the David Suggests Labs Joint Venture Program, we may share limited information necessary to attribute the referral and reconcile accounting, such as confirmation that a sale occurred and basic attribution details. We do not share SMS opt-in consent with partners for their marketing purposes.

C. Legal and Safety

We may disclose information to comply with applicable law, respond to lawful requests, protect rights and safety, investigate suspected fraud or security issues, and enforce our terms.

D. Business Transfers

If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, information may be transferred as part of that transaction.

Business Customers and Data Processing (Controller/Processor)

Many of our customers use the Services for business purposes. Depending on how a business customer uses the Services:

David Suggests as Controller: We act as a controller for personal information we collect and process for our own purposes (for example, operating our websites, managing our customer relationships, billing, marketing, and improving our Services).
David Suggests as Processor/Service Provider: When a business customer uploads, stores, or otherwise submits personal information into the Services as part of their use of the Services (for example, contact records, messages, scheduling data, or CRM-related data), David Suggests may process that information on the customer’s behalf under the customer’s instructions. In those cases, the business customer is typically the controller (or “business”) and David Suggests is the processor (or “service provider”).
If you interact with a business customer using our Services and want to exercise rights relating to data the business customer controls, you should contact that business customer directly. David Suggests will support our business customers in responding to such requests as required by applicable law.

The Services are operated mainly from the United States, and we may process and store information in the United States and other countries where we or our service providers operate. Data Retention

We retain personal information for as long as reasonably necessary to provide the Services and for legitimate business purposes, including security, fraud prevention, compliance, and dispute resolution.

Unless a longer period is required by law or necessary for legitimate business purposes:

We generally retain certain account logs and marketing list records for up to 30 days.
We retain account and customer relationship records while an account is active and for a reasonable period afterward as needed for operations, compliance, and dispute resolution.
Deletion requests: You may request deletion using our privacy request form or by emailing [email protected]. We aim to complete verified deletion requests within 48 hours where feasible, subject to legal, security, fraud-prevention, and operational requirements.
